Do not spam or randomly start !votekicks, do not !votekick to avoid being kicked, and do not !votekick without proper reasons. Votekicks are ban-able even if they are not passed since negative intentions can still be assessed and misusing it can lead others to misuse it. Kicks and bans are enforced based on how severe the rule has been violated. ENT keeps the right to enforce punishments as warning.

No. The rule that vks would be banned for, if illegal, was initiated more recently, making the cases you present from March invalid.

I would be more lenient if hoebell did not have prior offenses, but it seems he has not learned.

You were reported for starting that votekick + flaming; The votekick itself is legit, as long as the player is lagging (the votekick dind't go through and assuming you dind't try to kick him again, im assuming he stopped lagging). However your behaviour in that game was quite toxic.

What can I say much to that, I can only tell you that I do all the suffering and no longer occurs. Had I known that there will be so to an outcry, I would have acted differently.
