Yes, he is votekicked like LTD Rules say.
But draw wasn't mandatory, seems like you guys did for your will.
If you didn't want to draw, you couldn't draw although it can be regarded as unmannered behaviour, it's not against the rule.

Punishment on Tuesday(Merc changer) would be determined by Game Moderator.
